That's the one that I thought of too. On the original suit, the title is somewhat misleading, it wasn't 15 years later, but 1.5. I do have to wonder how they will determine the MRSA came from Kmart and not a Cook county hospital. You are far more likely to contract it in the hospital than out of it.

She died in cook county. It doesnt say where she was when she was tested for it, 17 days after the injury. *Disclaimer...the 15 vs. 1.5 years is inthe link, not in the 'title'. This title is 'Lawsuit'. When you click on link, it has 1.5 in that title.

The way I understood it when I read it was that he wasn't suing for the MRSA, but for the cut that caused the MRSA. So I am guessing his train of thought is that had she not received the cut, she wouldn't have contracted MRSA and therefore would still be alive. Just my take on it I may be mistaken.

I took it as the reason for the lawsuit is the injury wouldn't have happened if they didn't have the boxes laying around that she had to try to navigate through.

Smdh. Every store ive ever been in, at some point in time, ive had to turn around and go around because of shelves being stocked.

If KMart wouldn't have provided her with free personal transportation to ride around their store in the accident never would have happened. Should Kmart have been expected to give her free driving lessons for the scooter also? Simple solution for a retailer is get rid of the scooters.
