12.04.050 Burning leaves or rubbish permanent No leaves or rubbish shall be burned on any asphalt surfaced street or alley.
(Ord. 2004/05-57 § 1 (part))
Does this mean people can burn in an alley if its not asphalt, or does it mean you can't burn in an alley? It's burning season again, and it's not so nice to have the smell of burning leaves in your house. Someone is burning in the alley right by our backyard, and not sure if it's permitted.

This is November which anyone is entitled to burn every day of this month. We aren't suppose to burn on any asphalt, but we can burn on brick streets though. If your neighbors are burning on an asphalt alley way then I'd think that they are illegally burning then. M

Yep, M&M has it right. People used to be stupid enough to burn on Asphalt, which ruins it, so that is the reason for the law. They could have worded it better though.

I think on a gravel alley it would be permitted.. But then if they're obstructing traffic ---just a thought......

The key word was Asphalt, so yes you can burn in a ally if it's gravel.
