Once garbage has been put out on the curb for pickup it is considered public. I believe the Supreme Court ruled on this matter. When the city had garbage collections there were a few times when law enforcement would ride with us to go through a suspects garbage without being noticed. It is crap that these scumbags will walk up onto someone's property and take what they want. I have had a couple things taken during the years also. I even quit putting up decorations because of a couple attempted thefts during the night. I would like to be able to put them out but standing guard with a paintball gun all night isn't for me. Maybe WE ALL should become more involved in neighborhood watch. A "paintball gun"...I've had dreams lately of catching them, but it's not with any paintball gun..... Hard to get people involved in Neighborhood Watch when for the people that would be involved ARE the working people and asleep during the night when they strike...how do you combact that ?? M

I seen this older Man digging thru my garbage and I told Him to get going and not to dig thru my stuff...... He said it's not my property.......I then said when I have bank accounts and personal addresses in there that makes it my stuff....told Him to get wheeling, never seen Him again lol ARE YOU FRIGGIN SERIOUS??? ^^^^^ M :?

I seen this older Man digging thru my garbage and I told Him to get going and not to dig thru my stuff...... He said it's not my property.......I then said when I have bank accounts and personal addresses in there that makes it my stuff....told Him to get wheeling, never seen Him again lol It's good that the person respected your wishes and leaves your trash alone, but I think FOT is right and once you put that trash out to the curb it is considered public. The Supreme Court says that the Constitution doesn't provide that privacy. I don't feel it should be that way though. www.wweek.com/portland/article-1616-rubbish_.htmlI pulled up this story because I remember thinking at the time that it was funny that the Portland Mayor, Police Chief and District Attorney took advantage of it to go after others but then got pissed when reporters turned it on them. There are some states that provide protection of privacy, but I don't think Illinois is one. That is why they say not to throw away anything with personal information on it. There are also cities that define ownership of what is put on the curb so that they can control where the recyclables go. We lock our garbage can mainly to keep people from creating a mess looking for some treasure, but we do consider it our property until it is picked up by our contracted trash collector.

Rocket, I agree with video taping, but individuals making the decision to take someone's life for stealing scrap metal or anything else, I do not feel is right. We had some scrap metal stolen while it was sitting outside waiting for a truck to show up for it. SPD suggested that it was fair game because it was considered trash since we left it outside. It may be SPD policy to not consider it a crime when someone steals something that is outside, but I really don't think that is how our laws are written. I feel that even if it is put in a trash can, that it is still my property until collected by the authorized person. Obviously MNM didn't feel that her fence was fair game just because it was left outside. AND KYLE........................ SPD could not have been anymore helpful to this situation. NOOOOOOOOOOOO anything outside is not "ASSUMED" as being fair game for anyone, unless left BY the garbage / recycling. THAT fencing and posts of ours was clear up on our property along our back fenced in yard........... NOT in the alley for "FAIR GAME" nor out at the curb for garbage pick-up either! That is great to hear that SPD was very helpful. I've said before that I know that we do have some very good officers that really do want good for our community. The property that was stolen from us was not in the alley either, clearly was away from the trash. The way that they quickly loaded up and left made me think that they absolutely knew that it was not trash. However since there were no legal consequences for them, I bet that they just went on to do it more. If you had video, maybe we could compare and I could tell you who they are. My criticism for what I see as a lack of enforcement here is directed more at our City leaders than the officers working on our streets. I feel that some of the policies that they have been forced to accept and that creates some of the problems that we see, are because of a lack of funding for more officers to be able to provide better service and provide more consequences for the offenders. In all fairness, the newspaper did say that the recently passed budget allowed for the addition of a new officer and there has been some restructuring of the department. Maybe they are beginning to work on change. Maybe the Mayor will have some results to talk about at next years election? That would really be a good thing. Until we see the results of their actions, the problems are still problems though.

Last year there was a beat up red pickup driving around and through alleys taking peoples stuff. I saw it yesterday, went through the alley past my house. they were not the only ones taking stuff. I have done that to get rid of stuff knowing someone else may want it. Was that a small pick-up? I see one @ my neighbors (2 doors down, & yes he's a junk collector too!) all the time & it stopped in front of my house & the neighbors next door. I was thinking about THIS thread & wondering WHY it would be stopping? Garbage day was Tues. here.

I know a few guys who finally started going to job service and taking the 10-11 dollar an hour jobs offered..Funny how much better off they are now than when they were making the hundred dollars a day scrapping

Should never throw your any paperwork with personal info into the trash without shredding it. Actually, shred and put in recycle. If you don't have a shredder, just take scissors and cut up in skinny strips both ways where the personal info is located on it

LOL, maybe not shoot to KILL, but I could certainly see trying to take out a kneecap and walk with a gimpy leg the rest of their days......JK....but if you could actually get by with it..... I fear for our future if people are actually that brazen, that bold, that fearless, or that ignorant that they were never taught basic right and wrong. To respect other peoples property and possessions. We were taught at home, at church, scouts, 4H, maybe even SCHOOL to respect ourselves and other people and their stuff. What's the matter with these people, did they flunk Kindergarten or something? Bigdipper, Do you really believe taking "out a kneecap" for "dumpster diving" or picking up something you placed out for pick-up by "Waste Management" is reasonable? Should it? g
