17.16.030 - Who may submit permit applications. A. Applications for zoning certificates, special permits, or sign permits will be accepted only from persons having the legal authority to take action per the permit. By way of illustration, in general this means that applications should be made by the owners or lessees of property, or their agents, or persons who have contracted to purchase property contingent upon their ability to acquire the necessary permits under this title, or the agents of such persons (who may make application in the name of such owners, lessees, or contract venders). 17.16.050 - Staff consultation before formal application. A. To minimize development planning costs, avoid misunderstanding or misinterpretation, and ensure compliance with the requirements of this title, preapplication consultation between the developer, staff members, and the administrator is encouraged or required as provided in this section. There will be no charge for this preapplication consultation meeting; however, subsequent meetings with members of the city staff or consultants working for the city will be subject to labor and material charges to the applicant. That confirms the same problems that I've seen and been asking that they change, but obviously their recent hiding of their requirements for the Majestic Theatre shows that they don't seem to have made the needed changes. Since I doubt that I'd ever be able to convice my employer to hire a legal team to battle with the City just to get them to provide their requirements to reopen the Majestic Theatre, I'll keep talking about my opinion that it is wrong. I'll also cintunue talking about it being wrong that our City leaders do not control the negative bar impacts that has our City slashing the value of commercial real estate by so strictly limiting the uses. That is great that prospectuve buyers could possibly be able to get a Special Use Permit approval in advance if our City Manager doesn't play his politics with them, but the C-2 zoning is still very restrictive even with Special Use Permit consideration, isn't it? Being allowed to pay extra and jump through the hoops to be able to get advance permission to make it a beauty salon with two chairs or less (maybe 200 sqft of the 7500) or a low traffic generating office, doesnt add even a considerable amount of value to their investment, does it? It is a shame that our City leaders can't seem to control the ngative bar impacts to stop property values from being slashed, don't you think?

Push the limits of right and wrong? Is that what you call their stopping business and not following our laws? Maybe you should open your eyes so that you can see them stopping other businesses. If your eyes were open maybe you could have seen it reported in the newspaper that their restrictive zoning on Illinois Street had already stopped multiple prospective businesses at the former House of Furniture property. If your eyes were open maybe you could have seen that Katie's unanswered excessively high donation request included fire sprinklers "probably" being required and see that their not being open and upfront with the real requirements helped stop her business too. If your eyes weren't so closed to what our City does maybe you could see that they filed an FTC complaint to try to stop a new business for wanting to invest in our community and lower employer's health care costs. If your eyes were open you would see that their ridiculous overly restrictive snow removal ordinance exhibits their unfriendly to business attitude that stops others from even wanting to try having a business here. Yes, their unfriendly to business attitude seems to be why we have so few. It hurts our community. They should start doing things differently, don't you think?

Come on Kyle, it wouldn't hurt to keep it fresh for your readers would it? I mean, look what he posted in Rocket's thread about giving up: "A similar thing happened to my family. Instead of neighbors though it was the City who talked behind our backs claiming that it was obvious that we were sleeping at the Majestic breaking some laws that they turned their heads to. Then at Council Meetings I got dirty looks, they talked rude to me, and they told the public that we were illegal, although we were not. rocket, you should consider yourself lucky that they don't get the bad stuff that you think they are saying about you printed on the cover of the newspaper, and that they don't have the power to threaten you with fines for violations that don't exist or stop you from opening businesses with ridiculous, unjustified requirements, or hiding them all together. I guess you will just have to keep your eyes open and see what happens. I also heard yesterday that the bank building was sold, and there are plans to open a hotel and restaurant there. Aren't you going to explain about our City Manager working with prospective buyers on a Special Use Permit agreement without going through the public hearing, P&Z recommendation, and Council approval process, or the benefits of having to go through a legal battle for people invested in commercial property to be able to get some value out of their property?

What are you talking about? You don't really think that my talking about a few of the City's injustices against my family is a complete history of what has gone on, do you? When others want to claim that I am vindictive for my insignificant talking about our City with all of their resources snd legal authority, isn't it appropriate for me to bring up the history of our City's vindictive actions against my family that do not follow our laws to put my insignificant comments in the proper context? Aren't we supposed to study history in an effort to not keep repeating the same problems again and again? Since they are continuing to play their political games, refusing to provide their proper requirements to open a business and strictly limiting other businesses rather than enforcing our laws to control the negative bar impacts, doesn't it seem that we need to keep talking about the history of their turning business away from our community? I have a lot of money invested in Streator that I will never get back, including 22 more years of payments for my venture trying to have a downtown family oriented movie palace. My family doesn't even want to be in Streator because of the way our City leaders attacked them and refused to address the problems. I have to live with the losses and other negative impacts of our City being so vindictive and not following our laws, but you think it is such a burden for you to either read something again or force yourself to not read what I have to say. I find that very sad. Poor, poor, dog, I feel so bad for you. My employer was telling me a couple of days ago that Hoyt Alexander from First Farmers Bank and Trust called him, indicating that the price of the Majestic is lower now than what they had previously stated, and trying to interest him in the deal. The City is continuing to hide their requirements to reopen the theatre though. Do you realize that I could be producing more personal income by having a new theatre project to be working on? Our City Manager playing his politics with the requirements to open the Majestic Theatre not only has lowered the value of commercial real estate here, but also has a negative impact on my livlihood. However, you think it is such a burden on you to either have to read again what I have to say, or skip over it. Poor dog, it is a shame that you are so annoyed. Do you want to know how you can stop from being so annoyed? If you were able to convince our City leaders to start doing things differently, to stop turning away businesses, to start following and enforcing our laws properly, and produce better results. Why aren't you going after him to recoup your investment? Did you not hire a professional to protect your interests before you made an arrangement with Burke?

I understand all that, but to stick the kind of money that requires a repayment period of over 25 years for just business products and furnishings for a 2 screen theater is just plain insane, especially without consulting a professional.
